TitleCase for counsel's opinion
Date[1782]
DescriptionJohn Huggett by his will dated 30 Dec 1769 left his wife Anne all his land for life if she remained a widow and all his personal estate, subject to payment of his debts, and appointed her his sole executor. The will was proved on 3 Jan 1782. On 24 Jan 1782 Anne, as Anne Huggett, widow, daughter of Elizabeth Brazier, was granted the administration of the goods of Anne Kirby. Anne Kirby bequeathed Anne Huggett a moiety of her household furniture and other goods and left the residue of her goods and real estate to Elizabeth Brazier with the remainder to Anne Huggett. Elizabeth died about 10 days before John, who was then living abroad. John's personal estate does not cover his debts and his creditors are pressing his widow. The creditors require John's real estate to be subject to them and claim that as Elizabeth died in John's lifetime he became entitled to the residue of Anne Kirby's goods in right of his wife and that this should also be available for the payment of his debts. No date. [Date: latest date mentioned in document.]
