DescriptionDemandant: Adam son of William Wyberd; Stephen son of Simon Wyberd; Henry brother of Stephen son of Simon Wyberd; Thomas son of Laurence Wyberd; Thomas son of Thomas Wyberd
Deforciant: Walter of Bath ('Bathon'')

The plea was heard at Canterbury in the presence of Hervey de Staunton and his fellows ('socius'), justices itinerant.
Adam, Stephen, Henry, Thomas and Thomas claimed that Walter unjustly disseised them of 2 messuages, 60 acres of land, 3 acres of pasture and a moiety of 1 mill in Ickham. The prior of Canterbury Cathedral Priory, as lord of the fee, remitted the plea to the king. Adam and the others claimed that Margaret, their grandmother, had held the lands in the time of Edward I. Details of the descent of the lands to Margaret's sons, Simon, William, Laurence and Thomas, and grandsons (named) in partible inheritance. Walter denied their right and Margaret's seisin and submitted his claim to a jury instead of an assize, according to the custom of gavelkind. The claim was heard on 11 Oct 1313. Weresius de voloygnes, Nicholas of Sandwich, William Septvans ('de septem vannis') and Eudo de Shelingheld' chose William de Basing', William de Creye, John de herde, Henry of Barham ('Bereham'), Henry de Burne, Thomas le Coupere of Littlebourne, Thomas of Goodnestone ('Godwynestone'), John de Sandherst', Henry Perot, John of Ratling, Adam de Brockescumbe and Thomas of Bossington as jurors. The jurors found in Walter's favour and said that he should hold the lands. Adam and the others were in mercy. No date. [Date: handwriting and date of original.] Original dated 7EdwII, no month, but the case was heard on 11 Oct 1313.

Endorsed with description, stating that it is a plea concerning William de Berthone and the recovery of 'le Berton'', in late 14th cent hands.
