In a case of the withdrawal of tithes for the lands late of John Terry from the field called 'Puttokisdowne' in Eastry parish, between the prior and convent of Canterbury Cathedral Priory, plaintiffs ('pars actrix'), and 'Dominus' Thomas, vicar of St Mary's church Sandwich, defendant ('pars rea'). John is deputising for Mgr Thomas Moone, licentiate in decretals, commissary general of Henry Chichele, archbishop of Canterbury. Mgr Robert Kent is the priory's proctor and Thomas's proctor is Mgr Richard hadelsay. Recites the libel submitted on behalf of the priory and Thomas's counterclaim.The priory claimed that, as owners of Eastry church, it had always received, and been entitled to, the tithes until Thomas witheld them, and sought the restoration of the tithes and payment of compensation and costs from Thomas. Thomas claims that the lands late of John Terry are part St Mary's parish Sandwich and that the tithes from them therefore belong to him. He also claims to have received the tithes for a long time.
The dean, having considered all the evidence, decided in favour of the priory. The land lies with the lands of St Bartholomew's [Hospital, Sandwich] to east, the king's highway from Sandwich to Canterbury to west, where a boundary marker ('terminus') called 'Standard' is located, the lands of St Mary's parish, Sandwich, to north and the priory's lands to south. Thomas is to compensate the priory for any tithes withheld and to pay costs, which will be assessed later.
