There has been a dispute between John Elham, II, prior of Canterbury Cathedral Priory, and Thomas Forde of Canterbury, concerning a rent of 3s payable for a messuage and 2 shops in 'olde specheslane' in St Mary Magdalen parish ('otherwise called Fisshmanchurche') in the city of Canterbury, about which an assize of fresh force is now pending in the king's court. The parties have promised to submit to the arbitrators' award concerning the rent and recovery of damages and costs, and Thomas has bound himself to the prior in £20 to observe the terms of the award. The arbitrators found that the rent is due from the whole tenement and that the shops are vacant. The prior distrained in the messuage but an objection was made and he was disseised of it. The arbitrators order Thomas to pay the prior 19s 6d for 6½ years' arrears and to pay the rent, or the portion of it relating to the messuage. The tenants of the shops are also to pay their proportion of the rent. This decision in not to prevent the prior from distraining in any part of the messuage or shops for arrears in the future. Thomas is also to pay the prior 40s for costs. Given at Canterbury.
